of the President of the German Patent and Trade Mark Office of 14 April 2025 concerning the cessation of the filing option for EU designs at the German Patent and Trade Mark Office as from 1 May 2025

Article 35 of Regulation (EC) 6/2002 is amended by point 31 of Article 1 of Regulation (EU) 2024/2822 of the European Parliament and of the Council of 23 October 2024.

From 1 May 2025, in accordance with Article 35(1) of Regulation (EC) 6/2002 in its amended version, an application for registration of an EU design (previously: Community design) can only be filed with the European Union Intellectual Property Office (EUIPO).

As a consequence, the filing of applications for registration of EU designs at the German Patent and Trade Mark Office will no longer be possible from 1 May 2025. This means that the scope of application of section 62 of the Design Act ceases to apply.

The Notice No. 1/2003 of the President, which refers to the receipt and forwarding by the German Patent and Trade Mark Office of Community design applications, will be repealed as of 1 May 2025.
