of the President of the German Patent and Trade Mark Office of 9 August 2024 concerning the implementation of Council Regulation (EU) 2024/1745 of 24 June 2024 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine with respect to procedures before the German Patent and Trade Mark Office
The 14th sanctions package of the EU against Russia, which was adopted on 24 June 2024 and entered into force the following day, results in restrictions on the acceptance of applications and requests in pending registration procedures filed by Russian nationals, natural persons resident in Russia and legal persons, entities or bodies established in Russia.
With effect from 25 June 2024, the German Patent and Trade Mark Office therefore ceases to accept
- new applications for registration/grant of patents, utility models, trade marks, designs, protected designations of origin and geographical indications pursuant to point (a) of Article 5s(1) of Regulation (EU) 833/2014
and
- requests and submissions in pending application and registration procedures pursuant to point (b) of Article 5s(1) of Regulation (EU) 833/2014
filed by
- Russian nationals or
- natural persons resident in Russia or
- legal persons, entities or bodies established in Russia.
The German Patent and Trade Mark Office does not accept any new applications for registration/grant of the IP rights referred to above even if they are filed by those being sanctioned together with non-Russian natural or legal persons, entities or bodies resident or established outside of Russia.
The sanctions do not apply to nationals of an EU member state, of a country member of the European Economic Area or of Switzerland; neither do they apply to natural persons having a temporary or permanent residence permit in any of these countries.
As from 25 June 2024, any natural person resident in Russia must therefore indicate in relation to requests/applications and submissions whether they
- are a national of a member state of the European Union, of a country member of the European Economic Area or of Switzerland
or
- have a temporary or permanent residence permit in a member state of the European Union, in a country member of the European Economic Area or in Switzerland.
As from 25 June 2024, any natural person resident outside of Russia must indicate in relation to requests/applications and submissions whether they are
- a Russian national
and
- additionally, a national of a member state of the European Union, of a country member of the European Economic Area or of Switzerland or have a temporary or permanent residence permit in a member state of the European Union, in a country member of the European Economic Area or in Switzerland.
The relevant information must be provided in writing on a form issued by the German Patent and Trade Mark Office or, after the e-filing systems have been adjusted, electronically. Proof of the information must be furnished upon request.
